1. Acceptance of Terms

By accessing or using ArtaMail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. The Service is provided by Artatol ("we", "us", or "our").

2. Description of Service

ArtaMail is an email infrastructure platform that allows you to send transactional and marketing emails through our API and SDKs. The Service includes email sending, tracking, analytics, and contact management features.

3. Account Registration

To use the Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be at least 18 years old or have legal capacity to enter into contracts
  • Not share your API keys or allow unauthorized access to your account

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam or unsolicited bulk email
  • Send emails to purchased or harvested email lists
  • Send content that is illegal, harmful, threatening, or abusive
  • Impersonate any person or entity
  • Violate any applicable laws or regulations (including CAN-SPAM, GDPR)
  • Transmit malware, viruses, or any malicious code
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to our systems

5. Email Compliance

You are responsible for ensuring your emails comply with:

  • CAN-SPAM Act (for US recipients)
  • GDPR (for EU recipients)
  • CASL (for Canadian recipients)
  • Any other applicable anti-spam and privacy laws

All marketing emails must include a valid unsubscribe mechanism and honor unsubscribe requests promptly.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, service interruptions, or data loss.

7. Intellectual Property

The Service, including its software, design, and documentation, is owned by Artatol and protected by intellectual property laws. You retain ownership of your content and email templates but grant us a license to process and transmit them as necessary to provide the Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTATOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time through the dashboard settings.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved in the courts of the Czech Republic.
